Business and Game Naming Issues

Greetings,

After much dilemma, I have finally come up with a name for my game business, as well as a name for the game I have been working on for the past several years. I went to Google and found that there was a business which could potentially be in conflict with the one I came up with:

Their business name:
"<< company x >>"

My business name:
"<< company x >> Games"

My games name:
"<< company x >>"

  • << company x >> went out of business over 20 years ago.
  • << company x >> has nothing to do with games, software, or anything computer related.
  • << company x >>.org is currently in use where people go to talk about products they still have that were produced by << company x >>.
  • << company x >>.com is available, and I would like to use this domain for people to download my game.
  • In my opinion, the company name they chose doesn't even make sense for the products they produced ( obviously irrelevant, freedom to pick bad names is a great thing ).
    Am I able to legally name my Game/Business as specified above? Could << company x >> resurrect from the dead and legitimately sue me for whatever reason? Is there a good resource that someone could point me to that answers this question?

Setting up a business generally requires at least one visit to a lawyer, if nothing else to at least check over your incorporation documents, your tax status changes, your TOS and EULA and COPPA and other forms and statements, etc.

Part of that visit (or visits) should include asking them about it. You and your lawyer will discuss the risks involved. They are quite low, but risk never actually hits zero.

Part of your business plan should include fallback options. You really should come up with multiple good business names to choose from, and multiple good product names to choose from. If there are any legal issues with your favorite you still have others to consider.

The more I delve into business legal concerns, the more I agree with that statement.
