I have the Copyrights... how about the License?

hey guys. I just finished my game, and i got the copyrights. I need to define a license for free download, but not for sale... how can i do it? us there a model? or i right what ever i want? Other subject is... what about the trademark of my game's name and logo? Do i realy need it if i have the copyrights? Thanks

Under terms of international treaties, you automatically own the copyright as soon as you type it. It is possible to register the copyright with the government (getting a reistered copyright) but that's really only needed if you can forsee a lawsuit over the code.

I suggest that you just copy a license that you like if it meets your needs and wants. If you search but can't find one that you like, you really should talk to a lawyer about it.

Trademarks and copyrights are different entities.

Copyright law covers the ability to distribute and derive from another work.

Trademark law covers the distinctiveness and various marketing aspects of your stuff. The more distinctive and well known your marks are, the more 'strength' the mark has. If nobody knows about your product or your marks, they have almost no 'strength'. Trademarks are also limited by the industry and location where you use the mark.

Under terms of international treaties, you automatically have trademark protection when you use a distinctive mark in commerce. It isn't much protection (= weak trademark). It is mostly there to prevent a neighboring store from blatently stealing your marks. You can register your trademark at the state, national, and international levels (getting a registered trademark). Registered trademarks increase the strength of the mark.
