Its not legal to create a mario look alike (Remember Hasbro suing every indy game developer a few years back), but Nentendo will probably ignore it if you don''t charge for your game.

Also how many 2D mario clones are out there? AND using the original artwork from the mario games? Google for "Mario Clone" or "mario-like game" or something like that and you''ll find out you can spend the rest of your life playing mario clones.
