Working on upcoming DS title - sampling sampled instruments.
Hey guys
So i've been working in the biz for a while now but I've got my first DS title coming up which is great news, it's gonna be a big one... I've been looking over the Nintendo software and I have to create my own instruments and MIDI songs and compile it all... I'm curious about the LEGALITIES of effectively Sampling samples from instruments i own to use as my soundfont for my music??? Can i legally do this, or do I have to actually record all my sounds?

Hi David! Congrats on the DS title!! I just finished one myself, so I know the system you're having to work with. As I understood your question, you are wanting to know if you can use samples from the instruments you own in your music. My answer would be yes. The only time you have to question the legality of a situation like this is using samples that someone else created and produced. Since, as I understand it, you're doing all of the work- it's your sound. If you were going to "Bubba's Instruments Samples" and using his samples without any purchase of a license or anything- then you'd be in violation.

yeah as i understand it, it shouldn't be a problem when youre sampling lets say your Sampled Grand piano software to put into the DS software, because youre selling the music as a whole and not the individual samples.

Some samples/loops are not allowed to be exposed in raw form in electronic media. I would make sure to check.
