Thanks for the advices guys, I'll try to come up with better worded copyright and less buyer repulsive. If any of you is good in this area and has some suggestions please post them here...

You may want to contact a lawyer to have them draw up a license agreement that gives you what you want, while still giving people the freedom to use the models without fear of breaching the agreement. They (the lawyers) can make it all nice and legalese for you, so you won't have to worry about some loophole showing up.

I would recommend checking out other model stores instead. Use their license. No reason to blow money on a lawyer [wink]

You might also want to take a look at licenses that come with games to see how the professionals protect their stuff.

But that pack really rocks! I would also be very interested in medieval/fantasy people and creature pack for RPG :)

I think what you suggested makes sense, it sounds more friendly and protects us
from the case I mentioned. I think I'll start with what you suggested and rewrite the copyright from that standpoint.

Thanks to all other who replied with positive comments and those interested in pack but not sure about our copyright license. We'll rework it so you hoppefully will be more interested in using our pack.

We'd love to see it used in games. More people that are interested in buying this pack means we can put out more packs for you to use in your games (with friendly copyrights ofcourse ):)

I don´t think you can do much about the copyright issue - especially if you´re not supplying the entire art pack your files will have to be integrated in whatever the developer works with.
Everything can be extracted, and there is nothing effective you can do against people extracting or sharing your files. The only thing you can do is have a license that forbids this and cautions the developer to take "reasonable efforts" to prevent this. Besides, developers will share your copyright mindset, since you´re both on the same side.

The only area where I can see your stuff getting ripped is the small-timers who need some (any) models for their game. But nobody playing on a comercial level will risk getting caught with stolen art, so the only ones (apart from the incredibly stupid ones) who are going to rip your art are the non-profit indie devs.

My advice would be to focus more on content-on-demand, i.e. stuff made specifically for one game. In these times most studios try to outsource art, so if you have competitive prices and can meet deadlines you have a range of potential customers.

There´s also a range of other business models that might work to your advantage, like customised versions of stock models, limited-time exclusive usage contracts for art (developer gets custom-made or prefab content, after a certain time elapses the contract turns into unlimited, non-exclusive usage for the client and you´re free to resell the art), etc.

I'd say there is no way to protect your content if it's used in DX or GL, as any wrapper can just copy all the stuff you are submiting (textures, geometry) and voila...

As far as I know some companies use approach where they have tough licence on commercial apps, but less restrictive one on non commercial ones. Like there must be information where do models come from and how to purchase 'em, and how thay can or cannot be distributed. Moreover if your models are closed for free use, someone will steal them anyway, drop into p2p network, and they'll be distubuted without any licence (crator info) at all...

It's pretty much like releasing work, but there is really no way you can protect it 100%. AFAIK there are bunch of wrappers that take care of stealing, no matter what file format you distribute, your app will decode it beforehand and submit to stealing wrapper.

You're right, that clause is too harsh. I had bad feeling about it, that's why I added in the end: "Please, protect our work like you would protect yours. :)"

And this sentence explains it all, of course it's impossible to prevent hacking and that's why we can only trust people. What we wanted to tell is do your best to protect our pack like you protect yours.
Of course we don't ask ultra encrypted archive that not even your game will be able to open :)
I'm working for a 2D game company too, and even with keycode, the game is hacked in the following 2 hours :)

We took this from existing content pack and made some change. The fact that we are not native english speaker didn't helped :)

What a shame, and we wanted to make a good value. People who already bought it are really happy, only great comment, so I hope you will not take this wrong and eventually buy the pack.

I'll read carefully all your comments and try to take the best from them, then post the modified license here. I guess current customer won't mind since it's more freedom.

License:

Tridinaut retains all copyrights to the Medieval Weapons Pack.

You have the right to use the content in Medieval Weapons Pack in your
own game productions but you may not not redistribute it in whole or
in part aside from your own game production.

Third party that interacts/plays with your game/media creations does
not get the right to use content from Medieval Weapons Pack in their
own freeware/commercial game/media productions. It is you who is
granted this license and not the third party that interacts with your
creations.

Tridinaut retains the right to resell this work at any price to anyone
else, or stop selling it at any time.

At the end we would like to advise you to protect our work as your own.
