How to start an open source project?

I have been thinking in starting a new open gl game/engine as a freeware open source project, however I now realize I really dont know where to start. Im also not sure or where are the legal bounds of the project. My idea is to create a robust RTS game engine , able to read scripts and then allow users (and myself) to create content,maps, missions, campaigns and even entire games of their own with it. Im not sure if users would be able to Sell /distribute their campaigns/games Ive seen similar projects and they dont allow you to do that. (Im not sure why though) Im also sure I have to stay away from similarities from other games, but what does "similarity" actually mean? I cant use a double click to select units? I cant use any unit name that has appeared in any rts before? What other resources would I need? (besides a web site obviously) ftp, a cvs server probably. Open-source projects don''t sell the code, the executable itself. They sell the wrapping, the graphics, sound, and underlying gameplay.
